3. Cookies and Similar Technologies

The Website uses cookies, tags, pixels, scripts, and similar technologies to operate the Website, remember preferences, understand Website activity, prevent misuse, and measure advertising.

We use Cookiebot by Usercentrics to display our cookie banner, record consent choices, and allow visitors to manage or withdraw consent.

Cookies and similar technologies may be categorized as follows:

Necessary cookies support essential Website functions, form operation, consent management, security, and fraud prevention.

Preference cookies remember settings or choices that improve Website functionality.

Statistics cookies help us understand Website traffic, performance, and visitor interactions.

Marketing cookies may be used to measure advertising performance, create advertising audiences, or provide more relevant advertising.

Except where applicable law permits otherwise, nonessential cookies are used according to the choices you make through our cookie banner.

You may accept, reject, or customize nonessential cookies. You may later change or withdraw your consent through the Cookie Settings link available on the Website.

Blocking certain cookies may affect some Website functionality.

Analytics and Advertising

We may use Google Analytics, Google Tag Manager, and Google Ads to understand Website activity, manage Website tags, measure advertising performance, and improve the Website.

Depending on our settings and your consent choices, these services may collect device information, browser information, approximate location, cookie identifiers, page views, referral information, and general Website interactions.

We do not intentionally send names, email addresses, telephone numbers, project descriptions, message contents, uploaded filenames, or uploaded file contents to Google Analytics.

Our Google Analytics user-level and event-level data-retention setting is up to 14 months. Where the applicable reset setting is enabled, the retention period associated with a user identifier may restart when the user returns and generates new activity.

Spam Protection

We use Google reCAPTCHA on certain forms to help prevent spam, fraud, and automated abuse. reCAPTCHA may process device, browser, interaction, and network information. Google’s applicable privacy terms govern its processing of that information.

Fonts and Website Resources

The Website may use Google Fonts, Adobe Fonts, or similar services to display typefaces and other Website resources.

Depending on how these resources are configured, their providers may receive technical request information, such as an IP address, browser information, and the page requesting the resource.

Cookie Declaration

Additional information about individual cookies, providers, purposes, and durations may be available through the Cookie Declaration provided by Cookiebot.

Because Website technologies may change, the Cookie Declaration may be updated more frequently than this Privacy Policy.

Do Not Track and Privacy Signals

Some browsers offer a “Do Not Track” setting. Because there is no universally accepted standard for interpreting ordinary Do Not Track signals, the Website may not respond to them.

You can manage nonessential tracking through our Cookie Settings.

Where required by applicable law and supported by our consent-management platform, we may recognize legally valid opt-out preference signals, such as Global Privacy Control, as a request to opt out of qualifying sales, sharing, or targeted advertising for that browser or device.

Preferences selected on one browser or device may not automatically apply to another.

4. Newsletters and Marketing

You may choose to subscribe to occasional studio updates, selected work, service information, announcements, ideas, and other marketing communications.

Our email marketing provider may process your name, email address, subscription status, consent record, and general email-engagement information to deliver and manage these communications.

You may unsubscribe at any time through the link included in a marketing email or by contacting us.

After you unsubscribe, we may retain limited information on a suppression list to ensure that we continue to honor your request.

Unsubscribing from marketing messages does not prevent us from sending non-promotional communications relating to an inquiry, active project, invoice, agreement, or existing business relationship.

Providing a telephone number allows us to call or text you regarding your inquiry or project. We will not use your telephone number for promotional text messages unless you provide any separate consent required by applicable law.

Message and data rates may apply.

5. How We Disclose Information

We may disclose personal information to service providers and other recipients when reasonably necessary for the purposes described in this Privacy Policy.

These recipients may include:

  • Website hosting and form providers

  • Email, cloud-storage, and collaboration providers

  • Analytics, advertising, tag-management, consent, and security providers

  • Email marketing and newsletter providers

  • Accounting, invoicing, banking, and payment providers

  • Employees and independent contractors

  • Designers, developers, printers, production vendors, and other project collaborators

  • Attorneys, accountants, insurers, consultants, and other professional advisers

Employees, contractors, and vendors may receive access to inquiry information or uploaded files when reasonably necessary to evaluate a request, prepare a proposal, perform an accepted project, produce requested materials, or provide technical or administrative support.

Third-party providers process information according to their applicable terms, privacy policies, and, where appropriate, agreements with DSGNPORT. We disclose information only when reasonably necessary for the services they provide or as otherwise described in this Privacy Policy.

We may also disclose information when reasonably necessary to:

  • Comply with a law, subpoena, court order, or legal process

  • Respond to a lawful government request

  • Investigate fraud, misuse, or a security incident

  • Protect the rights, property, or safety of DSGNPORT or others

  • Enforce our Terms of Use or other agreements

  • Establish, exercise, or defend legal claims

Information may also be transferred in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, insolvency proceeding, or similar business transaction.

6. Sale, Sharing, and Targeted Advertising

DSGNPORT does not sell personal information in exchange for money.

However, certain advertising technologies, cookies, pixels, or identifiers may be treated as a “sale,” “sharing,” cross-context behavioral advertising, or targeted advertising under some privacy laws.

You may reject or disable marketing technologies through our Cookie Settings displayed on the Website.

We do not knowingly sell or share personal information belonging to individuals under 16.

7. File Uploads and Confidentiality

Uploading a file does not transfer ownership of that file to DSGNPORT.

By submitting a file, you represent that:

  • You own the material or have permission to submit it

  • The submission does not violate another person’s intellectual-property, privacy, confidentiality, publicity, contractual, or other rights

  • The file does not contain prohibited sensitive information, unlawful content, malware, or malicious code

  • DSGNPORT may receive, store, open, copy, and review the file for the purposes described below

You grant DSGNPORT a limited, nonexclusive license to receive, store, open, reproduce, review, and share submitted materials only as reasonably necessary to:

  • Review and respond to your inquiry

  • Evaluate the requested project

  • Communicate with you

  • Prepare an estimate or proposal

  • Share the materials with necessary employees, contractors, or service providers

  • Provide services after a separate written agreement has been entered into

Submitting an inquiry or file does not, by itself:

  • Create a client relationship

  • Create a nondisclosure agreement

  • Establish a fiduciary or formal confidential relationship

  • Require DSGNPORT to accept the project

  • Prevent DSGNPORT from working with other businesses

  • Give you exclusive rights to a general idea, style, method, or concept

  • Replace a signed client agreement

We will handle submitted materials with reasonable care. However, do not submit trade secrets, unreleased confidential information, or highly sensitive materials unless an appropriate written confidentiality agreement has first been signed.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

Our general retention practices are:

  • General inquiries that do not become projects: approximately 90 days after the last meaningful communication

  • Files attached to unsuccessful inquiries: approximately 90 days

  • Active project information: for the duration of the project

  • Working files for completed projects: generally up to five years after completion

  • Final deliverables and limited portfolio or ownership records: as reasonably necessary for archival, evidentiary, portfolio, or business purposes

  • Contracts, invoices, payment records, and accounting information: generally seven years or longer when legally required

  • Newsletter information: until you unsubscribe or the subscription is otherwise terminated

  • Suppression records: as reasonably necessary to honor an opt-out request

  • Analytics user-level and event-level information: up to 14 months, subject to our settings

  • Cookie-consent records: as reasonably necessary to document consent, rejection, preference changes, or withdrawal

We may keep information longer when reasonably necessary to comply with legal obligations, resolve disputes, collect amounts owed, investigate fraud, enforce an agreement, or establish, exercise, or defend legal claims.

Information may remain temporarily in backups after deletion from active systems.

Aggregated or de-identified information that does not reasonably identify an individual may be retained for longer.

9. Your Privacy Choices and Rights

Depending on where you live, the law that applies, and whether DSGNPORT is subject to that law, you may have the right to:

  • Request access to personal information

  • Request correction of inaccurate personal information

  • Request deletion of personal information

  • Request a portable copy of certain information

  • Withdraw consent

  • Object to or restrict certain processing

  • Opt out of qualifying sales, sharing, or targeted advertising

  • Opt out of marketing communications

  • Appeal certain decisions concerning a privacy request

  • Submit a complaint to an applicable privacy or data-protection authority

These rights may be subject to exceptions. For example, we may need to retain information to complete a transaction, maintain required financial records, protect legal rights, prevent fraud, comply with law, or honor an opt-out request.

California Residents

If and to the extent that the California Consumer Privacy Act or another California privacy law applies to DSGNPORT or a particular processing activity, California residents may have rights concerning access, correction, deletion, portability, sale, sharing, targeted advertising, and nondiscrimination.

DSGNPORT will not discriminate against you for exercising a privacy right granted by applicable law.

Where European Union or United Kingdom data-protection law applies, you may have rights to access, correct, delete, restrict, or receive a portable copy of personal information, object to certain processing, withdraw consent, and submit a complaint to an applicable supervisory authority.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

However, no website, email system, file-transfer method, or storage platform is completely secure. We cannot guarantee absolute security.

Use care when deciding what information to submit through a Website form or ordinary email.

11. International Processing

DSGNPORT is located in the United States.

Our service providers may process information in the United States or other countries where they operate. Privacy and data-protection laws in those countries may differ from the laws where you live.

Where applicable law requires safeguards for an international transfer, we or our providers may rely on legally recognized contractual or transfer mechanisms.

12. Children’s Privacy

The Website is intended for a general business audience and is not directed to children under 13.

We do not knowingly collect personal information from children under 13. If we learn that we collected such information without legally valid authorization, we will take reasonable steps to delete it.

13. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, resources, or services.

DSGNPORT does not control and is not responsible for the privacy, security, content, or practices of third parties. Your interaction with a third party is governed by that party’s own terms and privacy policy.

The inclusion of a link does not necessarily mean that DSGNPORT endorses or is affiliated with the third party.

14. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to the Website, our services, service providers, business practices, or applicable requirements.

The updated Privacy Policy will be posted on the Website with a revised Last Updated date.

Where required by law, we will provide additional notice or request renewed consent before materially changing how previously collected information is used.
